Kevin Lino, 27, the man accused of torturing and killing a homeless man under the Reserve Street Bridge in July, has refused extradition to Missoula again during a second court hearing in Louisiana.

Missoula County Sheriff's Office Public Information Officer Paige Pavalone said on Tuesday that authorities will have to take extra measures to have Lino returned to Missoula to face charges.

"Lino had another extradition hearing yesterday and he did not waive extradition," Pavalone said. "That means our transport and warrant supervisors have been in contact with the jurisdiction and the ball will be in motion for them to request a governor's warrant at this time."

Pavalone said it will be several weeks before authorities in Shreveport, Louisiana can bring Lino back to court.

"It can take anywhere from three to six weeks for a governor's warrant to be executed," she said. "It does have to be signed by the governor before he can be returned to Montana. He'll have another hearing at the end of this week, and we'll know more after that."

Lino is wanted for attempted deliberate homicide in the death of Gilbert Berry, 36, who was tortured, mutilated and shot in the head and then dumped in the Clark Fork River in July. His body was found by a fisherman several days later.

His accomplice, Angela Marchese, is also being held in Shreveport. She faces local charges for theft and possessing stolen property. Pavalone said once those charges are settled, Marchese will be returned to Missoula to face charges of accountability for deliberate homicide in Berry's death.
