Matthew Lloyd Voeks, 56, was charged in Missoula Justice Court on Tuesday, November 19 with sexual intercourse without consent after allegedly raping his roommate's girlfriend on Saturday, November 16.

Court documents indicate that the victim told police she had gotten drunk and passed out, and when she woke up, her pants were down and Voeks was on top of her. The victim said her boyfriend also lived in the apartment, but was not home at the time of the alleged sexual assault. She stated she was too ashamed to tell her boyfriend what had happened.

Court records go on to say that Voeks initially said the sex was consensual, but later during an interview at the police station Voeks admitted that the victim was too drunk to give consent, and that he took advantage of her intoxicated state.

Voeks was then arrested and charged with sexual intercourse without consent. Bail was set in Missoula Justice Court at $100,000. Voeks was returned to the county jail.
