Montana Attorney General Questions Constitutionality of New York Gun Control Law

Montana Attorney General Tim Fox announced today, March 12, that Montana had joined with 19 other states in urging the U.S. Supreme Court to review the constitutionality of a New York gun control statute.

A lawsuit known as Kachalsky v. Cacace, claims that the New York statute makes it too difficult for ordinary citizens to obtain a permit to carry a firearm outside their home, but the second circuit court of appeals decided to uphold the statute, provoking a response from more than a third of U.S. states.

“The Second Circuit’s decision deprives law-abiding citizens of their constitutional right to carry firearms for self-defense,” said Fox. “The fundamental right of all Americans to ‘keep and bear arms’ should not end at our front doors.”

Fox announced Montana’s position saying, “We urge the Supreme Court to grant this petition and recognize the right of all Americans, including Montanans, to lawfully protect themselves from unlawful violence outside their homes.”
