26 year-old Daniel Grady appeared in Missoula District Court before Judge Leslie Halligan and was charged with felony vehicular homicide while under the influence after a hit and run incident.

Grady was originally charged with negligent homicide after striking and killing 22 year-old Rebecca Romero on June 17.

Deputy Missoula County Attorney Brittany Williams describes what happened.

“Mr. Grady was driving under the influence at around two o’clock in the morning when he struck a 23 year-old woman in the crosswalk, and she died as a result of that incident,” said Williams. “He left the scene, did not call law enforcement, dial 9-1-1 or request any medical care for her.”

Court documents filed on Friday state that Grady’s blood tested positive for several substances, including marijuana, Valium and cocaine, however by the time his blood was tested it was nearly eight hours after the incident and no alcohol was detected after that amount of time. Williams said that there was also video evidence that proved Grady had been drinking that night at a restaurant and a casino and two bars.

She said if the case goes to trial, the jury will have choices over which charges to convict.

“A jury will be able to first consider negligent homicide while under the influence,” she said. “If they find him not guilty of that charge, then they will consider negligent homicide, and they will also consider leaving the scene of an accident which is a separate charge.”

Montana statutes state that felony vehicular homicide while under the influence is punishable by up to 30 years in the Montana State Prison, a fine of up to $50,000 or both, while negligent homicide can bring a prison sentence of up to 20 years.”

No trial date has been set. Grady has been in the Missoula County Jail on $100,000 bail since June 17.
