37 year-old Kathryn Louise Racicot was arrested on Saturday for allegedly driving drunk with three children in her car, ages 14, 12 and 5.

On Monday, Racicot appeared via video from the Missoula County Jail on three counts of felony criminal child endangerment, as well as a misdemeanor charge of aggravated DUI. Deputy County Attorney Jennifer Clark said 9-1-1 received a call regarding a suspicious vehicle that was parked illegally along Interstate 90.

"The man who called in the report followed the suspect vehicle as it swerved and struck a delineator post and then eventually came to a stop," Clark said. "We learned that there were three children in the car, and one of the children pulled the emergency brake to get the car to stop."

Clark said the aggravated DUI charge was brought due to the excessive amount of alcohol in the suspect's system,

"It's an aggravated DUI charge due to the BAC level," she said. "She provided a sample in the preliminary breath test of a ,342." The legal limit for DUI is ,08.

Clark said each count of felony child criminal endangerment is 10 years in prison and up to $50,000 in fines, while the aggravated DUI charge carries a possible sentence of up to one year in the Missoula County Jail and a fine of up to $1,000.
