Elderly Missoula Man Blew Double the Legal Limit During His 5th DUI Arrest
Missoula, MT (KGVO-AM News) - On July 29, 2026, at approximately 10:35 PM, a Missoula Police Department officer was at the intersection of South Higgins, stopped behind other vehicles at a light. When the light turned green, the vehicle in front of him took several moments to begin to move, and he realized another vehicle, two vehicles in front of him, was just idling at the light.
The front vehicle finally began to move, and the second vehicle between the officer and the first vehicle turned away. The officer was now following the suspect Black Dodge. The Dodge was swerving in its lane, and it appeared to bounce off the curbed median, followed by a puff of dirt. The vehicle moved into the right turn-only lane to go North on Russell, but then went straight at the intersection against traffic control.
The officer conducted a traffic stop at 39th and Pittman. He approached the driver, who identified himself as 65-year-old Joe Durr. Joe was shaking and had a mild odor of alcohol coming from the vehicle. Joe’s speech was scattered and choppy. His eyes were bloodshot and yellowish.

According to court documents, Joe said he had not had anything to drink. The officer said Joe seemed confused about where he was and denied needing medical attention. He said he was coming from Albertsons, which did not seem accurate considering where the officer first saw him.
Joe was asked to step out of the vehicle. Joe’s balance was poor, and he struggled to walk. He said he had multiple surgeries and chest issues. He said he had taken a Lortab that morning, but denied drinking.
Another officer arrived to assist in a DUI investigation. The officer noticed Joe’s eyes were jaundiced to the point where he could not see if they were bloodshot. Joe agreed to perform field sobriety tests. Joe said that he could stand, but his legs were shaking to a degree that the officer was worried he would fall. He sat back on the bumper.

Joe was unable to complete the HGN test because he consistently moved his head or looked away from the officer’s finger. The officer attempted to get Joe into position for a walk-and-turn test, but Joe stumbled. The officer stopped the attempt and escorted him back to the bumper to sit down. The officer determined it was not safe to do physical tests.
Joe agreed to provide a preliminary breath test after the PAST advisory and blew over double the legal limit of .08. Joe was arrested. He was read the Implied Consent Advisory and agreed to a breath test. He provided a sample of .153 BAC at the jail.
Joe is currently being charged with felony DUI, fifth offense.
