Missoula Police Arrest Man for Exposing Himself to a Minor
Missoula, MT (KGVO-AM News) - At approximately 11:00 p.m. on May 13th, 2023, Missoula Police Department Officers responded to the 2900 block of Brooks Street for a possible sex offense. Jane Doe 1 (age 18) told the officer that she and her sister, Jane Doe 2 (age 13), had just left the movie theater when they saw a man near a store masturbating.
According to court documents, Jane Doe 1 said that when she looked at the male, he began swinging his genitalia around. She said he was masturbating and described him to the officers. Jane Doe 1 said she wanted to protect her sister and was scared the male would walk over to them. She said she wanted to get away due to how uncomfortable he made her feel.
Jane Doe 2 told the officer that she was walking with her sister when her sister suddenly began rushing to get to the car. Jane Doe 1 told her sister that she saw a man masturbating and her sister looked over and saw the man. Jane Doe 2 confirmed she saw his exposed penis and that he made direct eye contact, but did not say anything to them. Jane Doe 2 said she was focused on getting into their car to get away from the situation.
Officers Locate the Suspect
Based on this report, an officer found a male matching the description at the described location and contacted him. He identified himself as 23-year-old Caleb Diamond. He confirmed he was on probation for “drugs and theft.” Diamond was detained and read his Miranda Rights. When asked, Diamond was adamant that he did not expose himself to anyone. Another officer contacted the On-Call Probation Officer who advised that Diamond had search terms for his property.
A short time later, Jane Does 1 and 2 returned to the scene. Before the officer could ask them about Diamond, Jane Doe 1 was able to positively identify Diamond with 100% certainty as the person they saw earlier in the evening.
An officer reviewed surveillance video from the store and saw Diamond exposing his penis as he was at the east side door of the business. He then walked to the main entrance doors on the west side with his penis exposed. Diamond moved out of the camera frame, however the officer could see Jane Doe 1 and Jane Doe 2 approaching the parking lot towards their car.
Officers Search Diamond's Backpack
Diamond’s backpack was searched incident to arrest and an officer found a Springfield Armory 1911 handgun. Diamond said he found it on the railroad tracks and it was not his. Officers confirmed it was reported as stolen through dispatch.
In the backpack, officers also found a vial of a crystalline substance that was consistent with methamphetamine. There was also a makeshift tube that was consistent with a device to ingest a controlled substance, two lighters, and a butane torch. When asked if he would provide urine for testing, he advised he would test positive for methamphetamine. Court documents indicate he stated he purchased the drugs from the night before from a stranger.
A Probation Officer confirmed to officers that Diamond’s possession of the gun was a violation of his probation terms. At the Missoula County Jail, Diamond admitted he had purchased a shotgun for his roommate, which is also a probation violation.
Diamond is currently being charged with felony indecent exposure to a minor where victim is under 16 years of age and defendant is more than four years older than victim, felony criminal possession of dangerous drugs, and indecent exposure - 1st offense.
On May 15, 2023, Diamond made his initial appearance in Missoula Justice Court. According to the Missoula Jail Roster, his bond was set at $50,000 for a probation violation and $25,000 for the other offenses.
