Missoula, MT (KGVO-AM News) - On November 11, 2022, at approximately 8:15 a.m., a Missoula Police Department officer was dispatched to the 3900 block of O’Leary Street for the report of a male sleeping in the driver’s seat of a vehicle. Police Public Information Officer Lydia Arnold picks up the story. 

“The person who had called 911 provided a vehicle description and provided the license plate associated with the vehicle,” Arnold said. “Dispatch told the responding officers that the vehicle returned stolen. Officers attempted to give verbal commands to the male when they arrived on the scene, but the male did not wake up. The officer had to approach the vehicle and bang on the side of the car to wake the male. The male was identified as Robert Marler.” 

Court documents indicate Marler was removed from the car and handcuffed so it could be verified that the stolen vehicle did not have any other occupants. 

“Marler was taken into custody and during a search incident to arrest, a large sum of money was located on Marler’s person,” Arnold said. “Marler has a history with law enforcement and is a known drug user. Marler has a prior possession of dangerous drug charge with intent to distribute from 2017. From outside the vehicle, the officer could see a collection of butane torches and a large knife.” 

According to Arnold, the officer could also see a box of Narcan. 

“Narcan is used to stop someone from overdosing on opiate-based drugs,” Arnold said. “There is no other medically recognized use for Narcan other than to prevent an overdose. The officer provided Marler his Miranda advisement. Marler spoke with the officer and the officer noticed physical indicators in Marler’s behavior consistent with an opiate, known as ‘on the nod’.” 

Arnold said a search warrant for Marler’s vehicle was applied for and granted. Arnold mentioned that the search yielded 45 grams of methamphetamine, 3.7 grams of cocaine, a schedule two controlled substance, and other items. 

Marler was transported to the Missoula County Detention Center. He is currently being charged with felony criminal possession with intent to distribute, felony criminal possession of dangerous drugs, felony theft, and criminal possession of drug paraphernalia. 

On November 14, 2022, Marler made his initial appearance in Missoula Justice Court, and his bail was set at $150,000.
