Missoula, MT (KGVO-AM News) - On February 21, 2024, at approximately 12:26 a.m., a Montana Highway Patrol Trooper observed an Acura TSX sedan driving toward him at a high rate of speed on Highway 93. Using radar, the trooper recorded the Acura going 81 MPH in a 65 MPH zone. A traffic stop was initiated and another trooper arrived on scene to assist.  

That trooper spoke with the driver who was identified as 57-year-old Rodney Sherman. The trooper noticed that Sherman’s eyes were droopy, bloodshot, and watery. According to court documents, Sherman admitted to consuming alcohol prior to the stop, but claimed it was well before. The trooper also noted in his report that Sherman’s speech patterns were “mumbled” and that he appeared “polite”, but “sleepy.”  

The trooper administered the Standardized Field Sobriety Tests to ensure Sherman was safe to drive. Sherman exhibited 4 out of 6 clues of impairment on the HGN Test, 3 out of 8 clues on the Walk-and-Turn Test, and 3 out of 4 clues on the One-Leg-Stand Test. A PBT was conducted and it showed that Sherman’s BAC was 0.00.

Court documents indicate Sherman stated he takes street drugs. When the trooper asked Sherman what kind of drugs and how much, Sherman changed his answer and denied taking any narcotics. The trooper arrested Sherman for DUI. The trooper also learned that Sherman has three prior DUI convictions out of Oklahoma. Sherman consented to a blood draw and then he was then taken to the Missoula County Detention Center. 

Sherman is currently being charged with felony DUI. On February 22, 2024, Sherman made his initial appearance in Missoula Justice Court and his bond was set at $10,000.
