Missoula, MT (KGVO-AM News) - At approximately 6:00 p.m. on April 12, 2025, a Missoula Police Department Officer was driving on W. Broadway and noticed a black Toyota Prius without any license plates. The officer conducted a traffic stop, and the vehicle drove into a parking lot.

The driver, 73-year-old Edwin Cuch, attempted to get out of the vehicle. The passenger also opened her door and attempted to get out. The officer advised both of the occupants to get back into the vehicle multiple times. Cuch got into his vehicle and shut the door.

The officer approached the vehicle and noticed an almost empty bottle of Black Velvet Whiskey in the cubby in the driver's door. The officer asked Cuch for his driver's license and he stated it was at the Poverello Center, along with the title and paperwork for the vehicle. The officer learned that Cuch’s license status was determined to be revoked.

The officer noticed Cuch had bloodshot and watery eyes, his speech was slurred, and he was hard to understand. As Cuch exited his vehicle, he was staggering and appeared to be unable to walk straight. The officer had to provide multiple commands for Cuch to listen to his instructions.

Cuch refused to participate in the Standardized Field Sobriety Tests. The officer read Cuch the Preliminary Alcohol Screening Test Advisory, and he refused. The officer told Cuch to turn around and face the patrol vehicle. Cuch refused to comply with the officer’s command, and he told the officer he didn't need to. The officer told Cuch he was under arrest and to turn around. Cuch resisted, but officers were able to place him into handcuffs. Cuch refused to provide a blood sample.

The officer told Cuch was going to apply for a search warrant. The officer transported Cuch to St. Patrick's Hospital and continued to type his application for a warrant. As the officer was typing the warrant and application, Cuch continued to repeat himself and told the officer to "just get on with the process" and "if you're going to arrest me, arrest me." The officer reminded Cuch he had already been placed under arrest. A blood draw was performed pursuant to the warrant.
