Missoula, MT (KGVO-AM News) - On October 23, 2024, at approximately 10:31 p.m., a Missoula Police Department officer responded to a fast-food parking lot after receiving a report that an adult male was unconscious behind the wheel of a vehicle in the drive-through. The officer arrived on scene and found the male, who was later identified as 36-year-old Brice Luraski. He was still unconscious inside his running vehicle. 

The officer knocked hard on Luraski’s window multiple times. Luraski finally woke up but was unaware of how long he had been unconscious. The officer noticed that Luraski had bloodshot eyes, a lack of balance, a dazed expression, dilated pupils, and smelled of marijuana. 

According to court documents, Luraski admitted to smoking marijuana earlier in the evening. The officer also observed a marijuana ingestion product inside the vehicle. Luraski declined to perform SFST’s due to the cold temperature. Then the officer took him to the police station and conducted the tests.  

Luraski exhibited 0 indicators of impairment on HGN, 5 out of 8 indicators of impairment on Walk-and-Turn, and 2 out of 4 indicators of impairment on One-Leg-Stand. Again, the officer noticed the odor of burnt marijuana emanating from Luraski.

Then Luraski provided an alcohol PBT showing 0.00. He also agreed to provide an oral fluid swab, but the test did not work correctly. Then the officer requested a blood sample, but Luraski refused. Because Luraski has four prior DUI convictions, including a prior felony DUI conviction, the officer obtained a blood warrant and transported Luraski to St. Patrick’s Hospital.  

After the blood draw, Luraski was taken to the Missoula County Detention Center. Luraski is currently being charged with felony DUI, fifth offense. His bond was set at $10,000.
