Montana’s cannabis community is buzzing, and not in a good way. Senate Bill 443 lists a THC cap of 15% for every kind of marijuana product. For supporters of the legalization of recreational marijuana, which passed the state Legislature in 2020, this is a slap in the face.

The bill’s sponsor, Sen. Greg Hertz, says today’s cannabis is too strong and that it’s linked to mental health problems, particularly among young people. But come on man! Adults deserve to choose their ideal potency. Setting those incredibly harsh limits destroys the spirit of consumer choice and may even drive consumers back to the black market. Soon, your neighborhood drug dealer will be back in business.

In 2020, Montanans approved recreational marijuana, supporting both the personal liberty aspect and the financial aspects of the market. Senate Bill 443 goes against that trust and feels like a betrayal to everyone who voted. It is simply trying to turn back the clock on the progress that we have made.

I know many people who are employed by or operating a cannabis business here in Montana. I have heard the stories. It is ridiculous how much the state requires of them. Operating in a guestapo style of surveillance and intimidation. Stop stepping on the heads of small business owners trying to swim. Montanans must speak out against this bill. And other bills that are targeting the cannabis industry in the 2025 Montana legislative session. It is up to us to make our choices and decide what the future of our local businesses is.
