A very crowded docket greeted Judge Landee Holloway in Missoula Justice Court on Tuesday after the long Labor Day weekend, but three cases garnered special attention.

The first defendant was 37 year-old Matthew McGraw, charged with felony assault with a weapon and misdemeanor partner or family member assault. Deputy Missoula County Attorney Mark Handelman described the incident to Judge Holloway.

“The State is requesting bail be set at $50,000,” Handelman began. “The charges stem from the defendant coming home and catching his wife cheating on him with another man, who we will refer to as John Doe. The defendant hit John Doe multiple times and threatened to kill him while aiming a shotgun at him. He also threatened to kill Jane Doe while pointing a shotgun at her.”

Bail was set at $40,000 for McGraw.

Chief Deputy County Attorney Jason Marks asked Judge Holloway to place 47 year-old Chad Lembke on $50,000 bail for stalking and for violation of a protective order. “Your Honor, I have prosecuted Mr. Lembke before, and I believe there may be some competency issues,” said Marks.

“I think he may be off his medication and he is being disingenuous with the court. The State would recommend $50,000 bail at this time. Of particular concern after I filed the charges is that Mr. Lembke had actually been to his ex-wife’s residence the day of his arrest. When he is on his medication I don’t have any concerns about him being in the community, but when he is not, and I don’t think he has been for several months, I believe he poses a significant risk to his ex-wife and their children.”

Judge Holloway set bail at $50,000 and remanded Lembke back to the jail.

The third case involved 33 year-old Jeremiah Spottedblanket, who allegedly assaulted three individuals under the Buckhouse Bridge, Handelman asked the Judge for $5,000 bail.

“The charge stems from the defendant going into a camp under the Buckhouse Bridge, brandishing two knives and threatening to assault two campers,” he said.

Judge Holloway noted that Spottedblanket had been designated a Level III Active offender, which necessitates bail being set due to the danger to the community. She set bail at $5,000 for Spottedblanket who gave the Poverello Center as his address.
