Man in Custody Charged with Sexual Intercourse Without Consent
41 year-old Anthony Rex Hoskinson, already in the Missoula County Jail on the revocation of a deferred sentence for DUI, has now been charged with felony sexual intercourse without consent.
Deputy Missoula County Attorney Brian Lowney provided details of the current charges against the defendant.
“On December 31, 2017, the victim in this case reported that Mr. Hoskinson had sexually assaulted her, and it happened on the night prior, that’s December 30th,” Lowney began. “She went to bed and then found Mr. Hoskinson on top of her in the night penetrating her vagina with his penis. The possible penalties are up to 20 years in the Montana State Prison and up to a $50,000 fine.”
Court documents indicate that Hoskinson and the victim shared an apartment with only one mattress. They had been drinking the night before, and when she awoke to find him sexually assaulting her, she said no and tried to push him away, but initially he did not comply. She was eventually able to push him off. He told police that he knew the victim did not want to have a relationship with him, and said, 'If I did it, it would be wrong.'.
Lowney said Hoskinson will face the consequences of the revocation of his deferred sentence, and then the District Court Judge would handle his plea to the charge of sexual intercourse without consent.
Hoskinson appeared in Missoula Justice Court on Wednesday, and is currently in the Missoula County Jail on $50,000 bond.
